We want The Cool Cafe' to be a place of relaxed enjoyment, fun, and socialconnection! In light of this we know more fun and enjoyment will be had byall when our patrons follow our guidelines and policies.

Liability Waiver:

Patrons entering The Cool Cafe' acknowledge the inherent risks present inan indoor play environment. While The Cool Cafe' works diligently toprovide a safe environment for all, certain risks, whether inherent in thefacility itself or caused by the actions of other patrons, are unavoidable. Byusing our facility, Patrons shall indemnify The Cool Cafe' its employees,volunteers, agents and officers against any and all liability incurred by anynegligent or willful act of the patron, caregiver, child, or other patrons. Acomplete copy of this Terms of Use and Liability Waiver is posted at the Cafe and is also available upon request from any team member.

The Cool Cafe' reserves the right to refuse service to any Patron whose presence detracts from the safety, welfare, and well-being of otherPatrons and the Cafe itself. The Cool Cafe' reserves the right to amendthese Terms of Use and Liability Waiver at any time.

The Cool Cafe':

Respect and kind manners are always expected of everyone in the Cafe'.Children and adults will be kind, respectful, and conscious of the safety of all patrons. Rough play or bullying will not be tolerated.Those unable to comply will be asked to leave the premises. They will not be allowed back in the Cafe' for the rest of the day. They willnot be allowed to come back to the cafe' until they have spoken witha supervisor at the Cafe' and they have been granted permission toreturn.All children and adults will play and behave according to the posted rules.Toys are for home. Safety is our highest priority, so no outside toys such asnerf guns, toy guns, balls, rackets, etc. are allowed to be played withat the Cafe'.Food is for the Cafe. It is best if food is eaten in the cafe and not taken intothe play space. Food needs to be eaten at the tables and drinksshould not be carried around or left to rest on the furniture or games.

The Cool Cafe' Policies:

Parents are invited to play and stay at the cafe whiletheir children are present:Age 5 or younger require a parent or an adult to supervise them in the cafe.Children and adolescents must follow the rules of the cafe and staff andrespect staff reinforcement. Two unheeded warnings will result in aconversation with the child and/or parent and encouragement to takea break from the cafe. The Cool Cafe' reserves the right to denyaccess to children who choose not to comply by our guidelines.

Our Safety Rules:

No running in the playground. Please watch for little ones and berespectful.No climbing on the furniture.No playing outside near the street, in the street or running towards thestreet. Children need to remain in the Cafe'.Children need to sign in and out of the Cafe' every time they enter and exit.

Parent’s or Guardian’s Permission and Release:

I certify that the information provided by the student/parent is accurate tothe best of my knowledge. I hereby give my consent for the child listedbelow to enter The Cool Cafe' space and play. I also give my permissionfor the members of The Cool Cafe' to have access to informationprovided here as well as to give first aid treatment to this/my child incase of injury. If emergency service involving medical action ortreatment is required and the parent(s) or guardian(s) cannot becontacted, I hereby consent for the child named below to be givenmedical care by the doctor or hospital selected by The Cool Cafe' staff

I understand and acknowledge that I am fully aware of and assume the risks (including but notlimited to the risk of serious bodily injury, property loss or damage) of (1) said minorchild’s participation in recreational activities. I understand that The Cool Cafe' willalways have an adult supervisor on site but that they are not responsible. I am solelyresponsible for the decision to allow my/the child to participate and attend recreational funat The Cool Cafe'. I recognize my responsibility to ensure that said minor childparticipates and attends The Cool Cafe' only if I believe that the child is responsible in asetting with multiple children and adolescents of all ages. I understand that The Cool Cafe'shall have no responsibility to pay for medical treatment and related costs if said minorchild is injured.

Knowing the risks described above, I agree, personally and on behalf of the minor child namedabove, to assume all the risks and responsibilities surrounding my minor child’s use of theThe Cool Cafe'. To the fullest extent allowed by law, I hold harmless and agree to indemnifyThe Cool Cafe', its officers, directors, faculty, staff, volunteers, employees and agents,from and against any present or future claim, cause of action, loss or liability for injuryto person or property, which said minor child may suffer or for which said minor child may beliable to any other person, related to said minor child’s participation in recreationalactivities at The Cool Cafe', resulting from any cause whatsoever, and regardless of fault.

I am at least eighteen years of age and mental competence to knowingly and carefully haveread and freely signed this Liability Waiver and Release Form (Minor Child). I understandand agree that no oral or written representations can or will alter the contents of thisdocument. I agree that this agreement shall be governed by the laws of the Commonwealth ofMontana (excluding its conflict of laws principles).

I HEREBY RELEASE AND WAIVE, ANY AND ALL CLAIMS , KNOWN AND UNKNOWN, THAT THECHILD/CHILDREN OR I MAY NOW OR LATER HAVE AGAINST THE COOL CAFE', ITS MEMBER(S),OFFICER(S), INSTRUCTOR(S), OPERATOR(S) AGENTS, VOLUNTEERS OR REPRESENTATIVESRELATED TO ANY ACT, OMISSION, STATEMENT, OR OCCURRENCE DURING OR RELATED TO THEUSE OF THE COOL CAFE' OR THE FACILITY, FOR , LIABILITY FOR DIRECT, INDIRECT, VICARIOUS,PUNITIVE AND ANY OTHER DAMAGE WHETHER SUCH PARTY WAS INFORMED OR WAS AWARE OFTHE POSSIBILITY OF SUCH LOSS OR DAMAGE.
